DESCRIPTION OF HOW TO LEASE A TOURIST APARTMENT, BUNGALOW, CHALET OR VILLA LEGALLY AND WITH FULL GUARANTEE.
1. Contact an ATA MEMBER COMPANY as they are all official tourism professionals and therefore provide guaranteed service and quality.
2. CONTRACT: There must be a written contract setting out the rights and obligations to be met by both parts. A contract is understood to be any written communication, a letter, fax or e-mail, stating details of the tenant and the company leasing the apartment or house, the type of lodging being booked, the time period of the booking, the total price, applicable taxes, and the services that are included.
3. MINIMUM SERVICES: Tourist lodgings that are available for lease must fulfil certain minimum technical requirements depending on their category. In any case, the minimum services that any establishment must provide for the tenant are: regular cleaning of the premises; supply of drinkable water (hot and cold); electricity, energy for cooking and, if necessary, for heating the premises; garbage collection, furniture, installations and fittings (adapted to the category of the lodging); and customer service during the stay for all questions related to the premises.
4. COMMON AND COMPLEMENTARY SERVICES: All common services, if any, must also be included in the total price of the lodging. For example: swimming pools, gardens, terraces with the corresponding furnishings, etc. Apart from these common services, the proprietor may also offer additional services such as: laundry, cafeteria, restaurant, parking space, etc. These are available separately.
5. DEPOSIT: the Real Estate Agency may charge, as a deposit, a percentage of the full price of the stay and this amount is usually the following (other amounts may, however, be established by mutual agreement):
· 40% of the total price when the booking is for a period of less than one month.
· 25% of the total price when the booking is for one month.
· 15% of the total price when the booking is for more than one month.
6. CANCELLATION CHARGES: If the tenant cancels the booking once the contract has been signed, the amount received as a deposit will be returned, but not the full amount as the company has the right to withhold compensation depending on when the cancellation is made:
· 5% of the deposit if the booking is cancelled more than 30 days before the date set to occupy the premises,
· 50% of the deposit, when the booking is cancelled with less than 30 but more than 7 days notice,
· 100% of the deposit, when the cancellation takes place in a period of 7 days or less.
Irrespective of these amounts, the company may have special conditions, always provided they are stated in the contract.
Any booking without deposit is held until 8 pm on the expected day of arrival, unless another agreement has been made. On the other hand, if a deposit has been paid and the tenant does not occupy the lodging, the company must maintain the booking for 48 hours. If the tenant confirms arrival during this time, the premises may be occupied for the period of time covered by the deposit.
7. SURETY: Another payment that the company may require from the tenant is a surety as a guarantee against any possible damage to the installations, furnishings or utensils. An inventory should be made of everything in the premises when they are first occupied. This amount may be as much as 25% of the total price of the lease and will be returned on completion of the contract provided there has been no damage to the premises.
8. PAYMENT: The remainder of the total amount of the lease is paid at the time that the premises are occupied, unless agreed otherwise.
9. STAYING ON THE PREMISES: The right to stay begins (unless agreed otherwise) at 4 pm on the first day of the contracted period and ends at 10 am on the last day.
In the event of not vacating the apartment, bungalow, chalet or villa, the tenant must compensate the company as must have been described in the contract. If the contract does not consider this compensation, the tenant shall pay a maximum rate of three times the cost of the rooms for each day the stay is exceeded.
If the tenant vacates the premises prior to the date until it was booked, the company must be paid compensation for the remaining days of the stay. The maximum amounts of this compensation are the same as those described for cancellations (see point 6)
10. REGULATIONS Apart from the rights and obligations of both parts, the proprietor may also impose a series of prohibitions for this type of premises, such as for example:
- The presence of more people than the maximum capacity of the apartment, bungalow, chalet or villa.
- Installation of furniture or performing any type of work
- Exercising the activity of providing lodging on the premises or using them for any purpose other than that agreed.
- Perform any activities or other behaviour contrary to hygiene or normal social standards or carry out any illegal activities.
- Use any device that alters the consumption of utility supplies.
- Use the premises to house unauthorised animals.
